Cheat Sheet: How Death of Settlement Talks May Help Banks

“To the extent that the CFPB gets in there first and cuts a deal, which has always been a looming threat to the AGs, that would probably lend more closure and relief to the servicers in the end than some kind of ongoing sideways negotiations with the AGs,” said Tim Rood, a partner and managing director at The Collingwood Group.

For GSEs, Budget Deal More Critical than Debt Ceiling

“In the short term, one can imagine that the FHA potentially might be able to backfill some of the demand that previously was satisfied by the GSEs,” says Brian O’Reilly, president and managing director of the Washington consulting firm Collingwood Group and a former director at Fannie Mae. “But even in that case if the government only has a limited number of dollars I have no idea what Treasury’s plans are going to be.”

Banks Win Flexibility From Regulators on Risk-Retention Rule

Tim Rood, a partner and managing director of The Collingwood Group, said the vertical approach does not accomplish the goal of risk retention.

“When you start getting into the vertical, you look like financial engineering, which is leveraging our risk which got us into this mess in the first place,” he said. “I don’t remember this working out so well with investors and private label mortgage-backed securities.”

He praises the horizontal form of securitization.

“The one most closely aligned with the intended purpose of risk retention appears to be the horizontal option,” Rood says. “If you think about it in the purest sense, the 5% was supposed to be a handicap and be the most pure of the options. It’s easy to calculate. It’s pure and simple in the sense that it’s very consistent with traditional risk management…you are setting aside what is for your potential rainy day fund.”
